Terms of Service

1. Acceptance of these Terms

These Terms of Service ("Terms") govern your access to and use of the Kosht mobile application and related services (the "App" or "Service"). By downloading, installing, or using Kosht, you agree to be bound by these Terms. If you do not agree, please do not use the App.

2. Who we are

The App is provided by Mykola Durytskyi, an individual developer based in Ukraine ("we", "us", or "our"). You can reach us at help@kosht.finance.

3. Eligibility

You must be at least 13 years old to use Kosht. If you are under the age of 18 (or the age of majority in your country), you may use the App only with the involvement and consent of a parent or legal guardian who agrees to be bound by these Terms on your behalf.

4. Your account

Some features require an account. You agree to provide accurate information, keep your login credentials secure, and take responsibility for all activity under your account. Notify us promptly at help@kosht.finance if you suspect any unauthorized use.

5. Licence to use the App

We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to use Kosht for your own personal, non-commercial purposes, in accordance with these Terms and the rules of the platform you downloaded it from.

6. Vira and AI-generated content — not financial advice

Kosht includes an AI assistant ("Vira") that generates responses, insights, and suggestions based on the information you provide.

Vira is for informational and organizational purposes only. It does not provide professional financial, investment, tax, accounting, or legal advice. Its responses may be incomplete or inaccurate and should not be relied upon as a basis for financial decisions. You are solely responsible for any decisions you make. For professional advice, consult a qualified specialist.

7. Your financial data

You are responsible for the accuracy of the data you enter into the App. Kosht is a tool to help you organize and understand your finances; it does not connect to or move money in your bank accounts, and it does not execute any financial transactions on your behalf.

8. Subscriptions and payments (Kosht Plus)

Kosht is free to download and use. Certain features may be offered through a paid subscription ("Kosht Plus").

Payments are processed by the App Store, not by us, and are subject to the platform's terms.
Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period.
You can manage or cancel your subscription in your App Store account settings.
Refunds are handled by the platform in accordance with its policies. We do not directly process refunds.

9. Privacy

Your use of Kosht is also governed by our Privacy Policy, which explains how your data is stored (including in your own iCloud via Apple CloudKit) and processed. By using the App, you agree to the Privacy Policy.

10. Acceptable use

You agree not to:

use the App for any unlawful purpose or in violation of these Terms;
attempt to reverse-engineer, decompile, or extract the source code of the App, except where permitted by law;
interfere with or disrupt the App, its servers, or connected services;
attempt to gain unauthorized access to other users' data or to our systems.

11. Intellectual property

The App, including its design, branding, "Kosht" and "Vira" names, logos, and all related content, is owned by us and protected by intellectual property laws. These Terms do not grant you any right to use our trademarks or content except as necessary to use the App.

12. Third-party services

Kosht relies on third-party services, including Apple (App Store, iCloud/CloudKit), Google Firebase (authentication and data storage), and Anthropic (which powers Vira). Your use of the App may be subject to those providers' terms. We are not responsible for the acts or omissions of third-party providers.

13. Disclaimers

The App is provided "as is" and "as available", without warranties of any kind, whether express or implied, including fitness for a particular purpose, accuracy, or uninterrupted operation. We do not warrant that the App will be error-free or that any data or insight it provides is complete or accurate.

14. Limitation of liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, or consequential damages, or for any loss of data, profits, or savings, arising from your use of or inability to use the App, including any decisions made based on Vira's output. Our total liability to you shall not exceed the amount you paid us (if any) in the 12 months preceding the claim.

15. Changes to the App and these Terms

We may modify, suspend, or discontinue any part of the App at any time. We may also update these Terms from time to time. Material changes will be reflected by updating the "Last updated" date, and continued use of the App after changes take effect constitutes acceptance of the revised Terms.

16. Termination

You may stop using the App at any time. We may suspend or terminate your access if you breach these Terms. Sections that by their nature should survive termination (including intellectual property, disclaimers, and limitation of liability) will continue to apply.

17. Governing law

These Terms are governed by the laws of Ukraine, without regard to conflict-of-law principles. Any disputes shall be subject to the competent courts of Ukraine, unless mandatory law grants you rights in your country of residence.

18. Apple-specific terms

If you download Kosht from the Apple App Store, you acknowledge that these Terms are between you and us, not Apple, and that Apple is not responsible for the App or its content. However, Apple and its subsidiaries are third-party beneficiaries of these Terms and have the right to enforce them against you. Any maintenance, support, and warranty obligations are ours alone, not Apple's.
